Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the Sequel application (the “Application” or “Sequel”) created by Romain Lefebvre (the “Developer”, “us”, or “we”).
By accessing and using Sequel, you (“User”) acknowledge that you have read, understood, and agree to be bound by these Terms and those set forth in the Privacy Policy. If you disagree with any part of the Terms and the Privacy Policy, you are not authorised to use the Application.
We may modify these Terms and the Privacy Policy at any time and such modification will be effective upon posting to the Application.
Subscriptions
If you choose to buy a Sequel+ subscription (the “Subscription”), payment will be charged to your Apple ID account at the confirmation of purchase. The Subscription automatically renews unless it is canceled at least 24 hours before the current period ends. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
The Developer may modify or remove features of the subscription at any time, with or without notice. Specifically, the Developer may change data providers as a result of pricing changes, changes to the terms of use, or other reasons. The Developer does not warrant that any particular data provider will be available in the future. You agree that the Developer will bear no liability to you or any third party in such event.
All purchases are final. The Developer cannot issue refunds for purchases charged to your Apple ID. The Developer, at its sole discretion and at any time, may modify the Subscription fees in accordance with Apple’s policies.
Third-Party Websites
Sequel may contain links to third-party web sites or services that are not owned or controlled by the Developer.
The Developer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the Developer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.
Intellectual Property
You agree that the Application, including but not limited to content, graphics, user interface, audio clips, video clips, editorial content and the scripts and software used to implement Sequel, contain proprietary information and material that is owned by us, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever, except for use of the Application for personal, noncommercial uses in compliance with these Terms. No portion of the Application may be reproduced in any form or by any means, except as expressly permitted by these Terms. You agree not to modify, rent, loan, sell or distribute the Application or content in any manner, and you shall not exploit the Application in any manner not expressly authorised.
User grants to the Developer a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate into the Application any suggestion, enhancement request, recommendation, correction or other feedback provided by User or any other party relating to the Application.
The Developer reserves all rights not expressly granted in the Terms.
The Apple name, the Apple logo, iTunes, iTunes Store, App Store, Apple Books, Apple Music, Apple TV, Apple TV+, Apple Arcade, Apple Podcasts, and other Apple trademarks, service marks, graphics, and logos used in connection with the Services are trademarks or registered trademarks of Apple in the U.S. and other countries throughout the world. You are granted no right or licence with respect to any of the aforesaid trademarks.
Limitation of Liability
In no event shall the Developer, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Application; (ii) any conduct or content of any third party on the Application; (iii) any content obtained from the Application; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Representations and Warranties
Your use of the Application is at your sole risk. The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Application is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, accuracy, fitness for a particular purpose, non-infringement, or course of performance.
The Developer, its affiliates, and its licensors do not warrant that a) the Application will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Application is free of viruses or other harmful components; or d) the results of using the Application will meet your requirements.
You understand that all information, data, text, software, sound, photographs, graphics, video, messages, tags, or other materials (“Content”) available in connection with the Application are the sole responsibility of the person from whom such Content originated. We do not control or monitor the Content made available in the Application by others and do not guarantee the accuracy, integrity, or quality of such Content. You understand that Sequel may expose you to Content that is offensive, indecent, or objectionable. Under no circumstances will we be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available on the Application.
Termination
You agree that the Developer may terminate your access to the Application, at our sole discretion, without cause or notice, and without penalty, at any time. We may also at any time discontinue providing access to Sequel, or any part thereof, with or without notice. You agree that any termination of your access to Sequel or any portion thereof may be effected without prior notice, and you agree that the Developer will not be liable to you or any third party for any such termination. Upon termination, your right to use the Application will immediately cease. If you wish to terminate your account, you may simply discontinue using the Application.
Updates to these Terms
At times it may be necessary for us to make changes to the Terms such as due to changes in the services we offer, Apple's policies and procedures, and/or applicable laws. We reserve the right to update or modify the Terms at any time without prior notice. Please review the Terms periodically.
The Terms were last updated on the date indicated at the top of the page. Any changes to the Terms will become effective when we post the revised Terms on Sequel. As set forth above, your continued use of the Application after any changes or revisions to the Terms shall indicate your acceptance and agreement with such revised Terms.
